National Indemnity seeks more than $30,000 over loss of tractor in I-77 collision

CHARLESTON – An insurance company is seeking restitution from a Michigan-based transportation company over a tractor-trailer collision that occurred in Kanawha County.

National Indemnity Co., as subrogee of Leath Livestock & Trucking LLC, filed a complaint in Kanawha Circuit Court against XPO Logistics Freight Inc. alleging negligence.

The suit states that there was a tractor-trailer accident on Aug. 23, 2017, on Interstate 77 in Sharon with the plaintiff's insured and one of the defendant's employees. The plaintiff alleges the accident was caused due to the fault and negligence of the defendant's employee and it is seeking recovery of damages suffered.

The plaintiff alleges because of the defendant employee's negligence, the Leath Livestock & Trucking tractor was ruled a total loss.

The plaintiff is seeking $35,723, interest and court costs. The plaintiff is represented by Steven H. Wyckoff of Wykcoff Law Offices in Pittsburgh, Pennsylvania.

The case has been assigned to Judge Tod Kaufman.
