Woman files suit against state Board of Risk and Insurance Management over denial of FOIA request

CHARLESTON – A woman is appealing the denial of her request for information from a state agency.

Brandy West filed a complaint in Kanawha Circuit Court against West Virginia Board of Risk and Insurance Management (BRIM) citing the Freedom of Information Act.

The suit states that the plaintiff submitted an FOIA request for information in 2017 to the defendant for information regarding court rulings, settlement agreements and more cited in the National Union Fire Insurance Co. of Pittsburgh's commercial general liability policy. 

The plaintiff alleges the defendant denied her request in August and she is appealing the denial.

The plaintiff is seeking the court to order the defendant to provide the requested documents, attorney fees and court costs. The plaintiff is represented by Christopher J. Heavens of Heavens Law Firm PLLC in Charleston.

The case has been assigned to Judge Tera Salango.
