PRINCETON – A Virginia couple says the Kia Sedona they purchased has potentially life-threatening issues.

Alisha and Joey Horn filed their complaint in Mercer Circuit Court against Kia Motors America.

According to the complaint, the Horns purchased the new 2018 van on March 19, 2019. The complaint does not specify where it was purchased, but it says they paid West Virginia consumer sales tax, license and registration fees on the vehicle.

After the purchase, the couple says they experienced repeated nonconformities with the vehicle that impaired its use and market value. They say some of the issues are potentially life threatening.

They say Kia has not conformed the vehicle to warranty or replaced the vehicle with a comparable vehicle. They say this has caused them to lose use of the vehicle, and it has caused them annoyance, inconvenience and expenses.

They seek revocation of acceptance and refund of the purchase price, including taxes, license and registration as well as other reasonable expenses. They also seek damages for costs of repairs and towing plus interest as well as for loss of use, annoyance and inconvenience. They also seek attorney fees, court costs and other relief.

The Horns are being represented by Anthony Salvatore of Hewitt & Salvatore in Fayetteville. The case has been assigned to Circuit Judge Mark Wills.
