Woman, father say Range Rover they purchased has engine problems

CHARLESTON – A Putnam County woman and her father say a Range Rover they purchased is a lemon.

Victoria R. Elmore and Charles W. Dent filed a complaint in Kanawha Circuit Court against Astorg Auto of Charleston Inc. and Jaguar Land Rover North America LLC.

According to the complaint, Elmore and Dent purchased the new 2018 Range Rover Evoque from Astorg in February 2019 for $51,292. It included a four-year/50,000-mile express warranty.

After the purchase, the plaintiffs say they had repeated problems with the vehicle, including engine problems. They say Jaguar Land Rover has not conformed the vehicle to its warranty or replaced the vehicle despite at least five service calls at the dealer. They also the defendants are in violation of the Magnuson-Moss Warranty Act.

The plaintiffs seek revocation of acceptance of the motor vehicle and a refund of the purchase price including sales tax, license and registration fees and other reasonable expenses. That includes cost of repairs required to attempt to conform the vehicle to warranty and damages for loss of use, annoyance and inconvenience. They also seek attorney fees, court costs, pre-judgment interest and other relief.

They are being represented by Gay Elmore of Elmore Law Offices in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
