Florida man sues Barboursville Moose Lodge after intoxicated woman injures him in car accident

HUNTINGTON — A Florida man is suing Barboursville Lodge No. 2586, Loyal Order of Moose after he was injured in a car accident.

K. Malik Ferguson filed the lawsuit in U.S. District Court for the Southern District of West Virginia at Huntington against the Moose Lodge and Lori King. He was injured in a lawsuit on July 28 after King left the Moose Lodge intoxicated and struck him on her way to her residence in downtown Huntington.

Ferguson claims King had gone to the Moose Lodge and left the bar intoxicated and allowed her to leave without arranging a taxi, Uber, Lyft or other transportation for King. When she was driving home, she struck Ferguson, who was standing in his yard at the time.

King also struck the parked car that Ferguson had just exited, according to the suit, pinning Ferguson's left leg to a tree.

"Rather than back away from Plaintiff and render aid to him, King continued to accelerate her vehicle and continued to press Plaintiff’s leg against the tree until the leg was irreparably damaged," the complaint states. 

Ferguson is seeking compensatory and punitive damages. He is represented by Michael J. Farrell of Farrell White & Legg.
