CHARLESTON — Instant Growth Hydroseeding is suing Cunningham Energy claiming it failed to pay more than $27,000.
In 2015, the plaintiff hauled water for the defendant per an agreement and provided invoices to the defendant, according to a complaint filed in Kanawha Circuit Court.
The plaintiff claims the defendant notified the plaintiff it was not able to pay the invoices, but they worked out an agreement for the defendant to pay $1,000 per month until the invoices were paid.
In 2019, the defendant stopped making payments, even though it still owed $27,375 on the invoices, according to the suit.
The plaintiff claims the defendant breached its contract with the plaintiff and was unjustly enriched at Instant Growth Hydroseeding's expense.
The plaintiff is seeking judgment in the amount of $27,375. It is represented by Joshua Rogers and Paige Vagnetti of Dinsmore & Shohl.
The case is assigned to Circuit Judge Carrie Webster.
