Charleston woman sues construction companies for cracks in her home

CHARLESTON — A woman is suing several construction companies alleging violations of the West Virginia Consumer Credit and Protection Act.

Charles Summers Jr. is doing business as Summers General Construction. CTL Engineering of West Virginia, Three Designs, Ronnie Bolen and Jimmy Calhoun, who is doing business as Calhoun Engineering and Surveying.

Pamela Baker contracted the defendants in 2015 to build her a home and in 2016 she noticed a crack forming, according to a complaint filed in Kanawha Circuit Court.

Baker claims Summers and Calhoun came and examined the crack and told her not to worry about it because it was likely just the home settling. In 2019, she noticed the door to her basement was not closing properly, but she also assumed it was a settlement issue. In 2020, the cracks were getting worse and she contacted an engineer to look at it and he deduced it was a structural problem and recommended immediate repair.

Other repairs were needed, all totaling nearly $100,000. Baker claims the defendants violated the CCPA for unworkmanlike work performed in the building of her home, according to the suit.

Baker is seeking compensatory and punitive damages. She is represented by Benjamin Sheridan of Klein and Sheridan.

The case is assigned to Circuit Judge Maryclaire Akers.
