Woman says she was injured while shopping at Lowe's

State Court
Lowes

CHARLESTON — A woman is suing Lowes Home Centers alleging she was injured while shopping at Lowes.

Two unknown, unnamed employees were also named as defendants in the suit.

Sarah J. Kendall was at Lowes on June 25, 2019, in South Charleston and was shopping when lumber fell from a shelf and struck her, according to a complaint filed in Kanawha Circuit Court.

Kendall claims the defendants failed to take reasonable care and caution with respect to the placement and control of the lumber and allowed it to strike the plaintiff.

The unknown, unnamed employees negligently failed to inspect the placement of the lumber and should have known the placement was unsafe, according to the suit.

Kendall is seeking compensatory and punitive damages. She is represented by W. Jesse Forbes and William C. Forbes of Forbes Law Offices.

The case is assigned to Circuit Judge Ken Ballard.
