CHARLESTON — A lawsuit against Elk Energy Services claiming an employee did not receive pregnancy accommodations when requested has been dismissed.
Kayla Metheny Shay was employed by the defendant beginning in 2014 and was a lead environmental inspector and an environmental coordinator inspector in December 2017 on Spread D of the Mountain Valley Pipeline, according to a complaint filed in Kanawha Circuit Court.
Shay claims she became pregnant with her second child in January 2020 and informed her direct supervisor that her pregnancy was high risk due to preeclampsia and a prior c-section. She claims after informing her supervisor of this, she was discriminated against and harassed and interrogated about the ability to perform her job.
Shay claims all of her office-based duties were reassigned to Kevin Barnhouse and she was required to be in the field full-time. She claims the defendant maintained a hostile work environment and refused to provide her pregnancy accommodations.
Shay is seeking compensatory damages. She is represented by Stuart Calwell, L. Dante diTrapano and D. Christopher Hedges of Calwell Luce diTrapano in Charleston.
The lawsuit was dismissed November 3. The case was assigned to Circuit Judge Louis Bloom.
