MORGANTOWN – A former employee is suing the West Virginia University Board of Governors after he claims he was a victim of discrimination and retaliation. Mark Stewart began his employment with WVUBOG as the Associate Director in the Procurement, Contracting and Payment Services Department at the university, according to a complaint filed March 4 in Monongalia Circuit Court.
MORGANTOWN – A woman is suing Monongalia County General Hospital after she claims it and several physicians are responsible for her family member’s death.
MORGANTOWN – A Morgantown man is suing Stonerise Health Care LLC after he claims he was discriminated against because of his disability and sexual orientation.
CHARLESTON – The West Virginia Supreme Court of Appeals said the Town of Granville did not go against state code when it adopted an ordinance regarding mobile homes and house trailers. Patrick Russell and Sylvia Smith appealed a March 30, 2015, order by Monongalia Circuit Court in which the court found that the Town of Granville had authority to adopt an ordinance regulating the placement of mobile homes and house trailers, according to a March 15 opinion.
MORGANTOWN – Two women who have power of attorney are suing Worthington Nursing & Rehabilitation Center after they claim their family member was injured during her stay with the center. Charlene Kimberly and Deanna Cramer were also named as defendants in the suit. PWNR LLC is doing business as Worthington Nursing & Rehabilitation Center.
MORGANTOWN – A man is suing Genesis Youth Crisis Center after he claims his appendix burst and he was in severe pain. The West Virginia University Board of Governors was also named as a defendant in the suit. Tommy J. Eddy III was placed at Genesis on Dec. 6, 2011, as a juvenile and on Jan. 12, 2012, he became very ill with severe abdominal pain and vomiting, according to a complaint filed Feb. 23 in Monongalia Circuit Court.
KINGWOOD – A man is suing R&R Operations LLC after he claims he was injured from a fall from a rooftop. Mark Ball, Sheri Ball, Shorthorns LLC and Maine Crossings LLC were also named as defendants in the suit. On Dec. 14, the defendants in the suit filed motions to dismiss the lawsuit, citing improper venue. The court ordered that the case be transferred to Preston Circuit Court from Monongalia Circuit Court.
MORGANTOWN — A suit filed by a Pennsylvania couple seeks damages from the Hampton Inn in Morgantown and its owners over a dispute involving an alleged infestation of insects and mites.
CHARLESTON – State Supreme Court Justice Robin Jean Davis said the majority has continued to ignore the plain language of West Virginia code in a recent opinion.
CLARKSBURG – A man is suing Eastern Associated Coal LLC after he claims it discriminated against him because of his age. Henry Metz was employed by Martinka/Tygart River Mine and was laid off when it was closed in 1995, according to a complaint filed Nov. 23 in Monongalia Circuit Court and removed to federal court on Dec. 21. An amended complaint was filed on Jan. 7.
The owner of a landscaping and snow removal service is suing the Monongalia County Commission, the county sheriff and a deputy sheriff over what he claims is the improper seizure of his truck.
CHARLESTON – The West Virginia Supreme Court of Appeals has ruled that the circuit court erred in its decision to not credit State Farm for an advance payment.
MORGANTOWN – A woman and her husband are suing West Virginia University Hospitals after they claim it is responsible for injuries she sustained while she was a patient at one of its hospitals.
MORGANTOWN – A Monongalia County couple is suing West Virginia Rehabilitation Hospital Inc. after they claim its negligence caused injuries. West Virginia Rehabilitation Hospital is doing business as Healthsouth Mountain View Regional Rehabilitation Hospital.
CLARKSBURG – A lawsuit against Bob Evans Farms for wrongful termination has been removed to federal court. The plaintiff is a resident of Harrison County and Bob Evans Farms’ principal office is in New Albany, Ohio, according to the Dec. 17 notice of removal. MORGANTOWN – Several people from Maine, West Virginia and Pennsylvania are suing two Monongalia County men over injuries they allegedly sustained during a boat collision
