    CLARKSBURG – A woman is suing Verizon Communications after she claims it violated the West Virginia Wage Payment and Collection Act. Kelly Renee Carney was employed by Verizon in its call center in Clarksburg, according to a complaint filed in Harrison Magistrate Court and removed to federal court.

    BECKLEY – A man is suing Auto Trakk LLC after he claims it violated the West Virginia Consumer Credit and Protection Act. Virgie Graham became in arrears upon an alleged indebtedness to the defendant and the defendant began to engage in collection of such indebtedness through the use of telephone calls placed to Graham and by written communication to collect the debt, according to a complaint filed in Raleigh Circuit Court and removed to federal court.

    BECKLEY – A federal judge says former Massey Energy CEO Don Blankenship doesn't have to pay $28 million in restitution. In her April 4 order, Judge Irene Berger said Blankenship doesn't have to pay Alpha Natural Resources back for the legal fees it paid at least seven former Massey employees, investigative expenses and fines in relation to the 2010 Upper Big Branch explosion in Raleigh County that killed 29 miners.

On Feb. 7, 2014, Gary Gordon was a lawful customer/patron at Wheeling Island’s premises when he was caused to violently slip and fall on the unmaintained/unsafe walkway area with such great force as to cause Gordon serious injuries, damages and losses, according to a complaint filed Feb. 7 in Ohio Circuit Court and removed to federal court on March 14.

    CLARKSBURG – A woman is suing Zales Jewelers after she claims it violated the West Virginia Wage Payment and Collection Act. Ashley Bond was employed as a consultant and manager with Zales until her employment was involuntarily terminated on Dec. 7, 2013, according to a complaint filed Feb. 9 in Harrison Circuit Court and removed to federal court on March 18.

    HUNTINGTON – A lawsuit against Wal-mart for an Achilles’ tendon injury has been dismissed from federal court. The lawsuit was dismissed on Jan. 12 by District Judge Robert C. Chambers after the plaintiff, Jennifer Bradshaw, and Wal-mart resolved all issues involved in the complaint and moved to have the lawsuit dismissed. The lawsuit was dismissed with prejudice.

    CLARKSBURG – The federal government is suing a convicted landlord after it claims he discriminated against tenants based on their sex. Brian Carl Walden, as conservator for Gary Walden, a protected person, and as administrator CTA of the estate of Tina Walden; Walden Homes LLC, which is doing business as Walden Rentals; and 973 Chestnut Ridge Road Inc. were also named as defendants in the suit.
