Attorney Ben White says he plans to re-file the lawsuit next week. He said he’s had financial problems as a result of the economy and had to downsize his law practice.

    CHARLESTON – U.S. District Judge John Copenhaver Jr. has issued a temporary restraining order preventing Fayette County from enforcing a county-wide ban on the storage and disposal of oil and gas waste. “Having reviews the verified complaint and motion, supporting exhibits and memorandum of law, and having conducted a hearing on the motion on January 19, 2016, the court grants a temporary restraining order…” the Jan. 20 temporary restraining order states.

    CHARLESTON – An attorney who once filed a water contamination lawsuit against Massey Energy now has sued former Massey CEO Don Blankenship for abuse of process and malicioius prosecution. Kevin Wayne Thompson filed his federal lawsuit Jan. 11 in U.S. District Court in Charleston against Blankenship, attorney Daniel L. Stickler and the Jackson Kelly law firm.

    RICHMOND, Va. — The Virginia Supreme Court has ordered a company owned by West Virginia Democratic gubernatorial candidate Jim Justice’s family to pay more than $1 million to a coal operator. On Jan. 7, the Supreme Court upheld a previous judgment by the Dickenson County Circuit Court in a case filed by Lambert Coal Company, which had sued Virginia Fuel and James C. Justice Companies Inc. for the balance owed for the acquisition of Dark Hollow Strip Mine and two additional Lambert coal leases.

    MARTINSBURG – A former employee is suing U.S. Customs & Border Protection after he claims it has not responded to his FOIA request he made nearly a year ago. Dennis Finbarr Murphy was employed under a federal contract as an armed security guard at the CBP’s Advanced Training Center in Harpers Ferry until his termination in September 2014, according to a complaint filed in the U.S. District Court for the Northern District of West Virginia.
