CLARKSBURG — A woman is suing Tours Consulting LLC and telemarketers Lisa Ferrari and Dandrea Harris for alleged invasion of privacy and violation of telephone harassment statutes.
CHARLESTON – A woman is suing Chase Bank after she claims it violated the Telephone Consumer Protection Act. Marcie Biggs became in arrears upon an alleged debt to Chase and the bank began to engage in collections of the debt, according to a complaint originally filed in Putnam Circuit Court and later removed to federal court.
CHARLESTON – The West Virginia Supreme Court of Appeals has ruled that a 2014 Frontier class action lawsuit needs to be remanded back to state court to go through arbitration.
HUNTINGTON – A couple is suing Capital One Bank after they claim it violated the West Virginia Consumer Credit and Protection Act. Richard Davis and Deborah Davis became in arrears upon the alleged indebtedness to the defendant upon their account with Capital One Bank and the defendant began to engage in collection of the indebtedness, according to a complaint filed Feb. 16, 2016, in Cabell Circuit Court and amended on Dec. 29.
WAYNE – A man is suing Weltman, Weinberg & Reis Co. after he claims it violated the West Virginia Consumer Credit and Protection Act. After Gerald Curry became in arrears upon the alleged indebtedness to the defendant upon his account and the defendant began to engage in collection of such indebtedness through the use of telephone calls placed to Curry and by written communications, according to a complaint filed in Wayne Circuit Court.
WAYNE – A woman is suing Midland Funding after she claims it violated the West Virginia Consumer Credit and Protection Act. Between January 2012 and February 2014, the defendant contacted Brandy S. Hayton numerous times over a debt that Hayton disputed and Midland did not respond with a notice of investigation or actually conduct an investigation, according to a complaint filed Feb. 16 in Wayne Circuit Court.
HUNTINGTON – Summary judgment was granted in a lawsuit against St. Mary’s Medical Center alleging wrongful termination. Circuit Judge Christopher D. Chiles dismissed the lawsuit with prejudice, after hearing oral arguments from the parties regarding summary judgment on Feb. 5. The order was filed Feb. 16.
CHARLESTON – A man is suing the Offices of Rockwell Copeland Roth LLC after he claims it violated the Fair Debt Collection Practices Act. On Dec. 15, Mark Tscherne received a phone call from John Belfort, a duly authorized representative of the defendant, who stated that the defendant was a legal processing firm and calling in reference to a civil lawsuit that was filed against him in an attempt to collect debt, according to a complaint filed Feb. 11 in the U.S.
