SUMMERSVILLE — A lawsuit has been filed against both the north and south districts of the Church of the Nazarene, as well as the Nazarene Camp in Summersville alleging the respondents defamed him and caused him distress.
CHARLESTON – Kanawha Circuit Judge Joanna Tabit dismissed Richwood Mayor Bob Henry Baber claims against State Auditor J.B. McCuskey in his lawsuit after he was put on administrative leave while the McCuskey’s office performed an investigation.
CHARLESTON – The U.S. Supreme Court has declined to hear the appeal of Nicholas Circuit Court Judge Stephen O. Callaghan. On Sept. 25, the Supreme Court, the Supreme Court justices considered hearing arguments. They denied the petition on Oct. 2.
CHARLESTON – A couple is suing Wal-mart after they claim it is responsible for injuries sustained on the premises of one of its stores. Tommy Comer, a manager at Wal-mart Store #1477, was also named as a defendant in the suit.
CHARLESTON – Nicholas Circuit Court judge-elect Stephen Callaghan has filed a lawsuit asking for a federal judge to dismiss a disciplinary case against him. Callaghan is facing ethics charges for campaign tactics during the May primary, in which he defeated longtime Nicholas Circuit Judge Gary Johnson by just over 200 votes.
CHARLESTON – The West Virginia Supreme Court of Appeals has ruled that a woman can get a new trial in a lawsuit under a personal injury claim, but not under a wrongful death claim.
SUMMERSVILLE – A three-judge panel has dismissed a removal petition against the Nicholas County Commission, its president and two commissioners. The judges granted an order granting the respondents’ motion for summary judgment, according to the Jan. 4 order. The three-judge panel included Judges Phillip D. Gaujot, John W. Hatcher Jr. and Timothy L. Sweeney.
SUMMERSVILLE – A woman says she was injured during a visit to a city park in Summersville when she stepped on a water meter lid and fell into a manhole.
SUMMERSVILLE – A man says officers from the Summersville Police Department seized his property without a warrant and, with the county prosecutor, have kept his money without a probable cause hearing.
SUMMERSVILLE -- A Birch River couple says their four-year-old suffered a ruptured spleen after a doctor at their local medical center failed to diagnose the condition.
